Welcome to GiftWell. These Terms of Service ("Terms") govern your access to and use of GiftWell's website, mobile application, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. About Our Service

GiftWell operates a platform that allows users to purchase, send, and redeem digital gift balances that can be used to obtain vouchers for health, wellness, productivity, and learning applications and services, or donated to charitable organizations.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

3.1 Optional Accounts

While you can receive and redeem certain gifts without creating an account, creating an account allows you to:

• Track your balance and transaction history
• Store remaining balance after partial redemptions
• Manage multiple gifts
• Access enhanced features

3.2 Account Requirements

If you create an account, you must:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities under your account

3.3 Account Restrictions

You may not:

• Create multiple accounts for the same individual
• Share your account credentials with others
• Transfer or sell your account to another person
• Use another person's account without permission

4. Purchasing Balance

4.1 How It Works

You can purchase digital balance to gift to others or use yourself. When purchasing:

• Select the amount (minimum $5, maximum $1,000 per transaction)
• Specify the recipient (email, phone number, or physical address for physical delivery)
• Pay any applicable service fees (for physical delivery only)
• Choose specific app voucher or general balance allowing recipient to choose

4.2 Fees

• Digital Delivery: No service fee
• Physical Delivery: Flat service fee applies to cover shipping and handling
• All fees are clearly displayed before purchase and charged to the sender
• Fees are non-refundable

4.3 Payment

We accept payment via major credit cards, debit cards, and other payment methods made available through the Service. You authorize us to charge your selected payment method for all purchases. You represent that you are authorized to use the payment method you provide.

5. Balance Expiration

Gift balances expire after 5 years from the date of purchase if not redeemed or donated. We will send email notifications at 1 year, 6 months, 3 months, and 1 month before expiration.

Once balance expires, it is forfeited and cannot be recovered, redeemed, or refunded. We encourage you to donate expiring balance to charity rather than letting it expire.

6. Refunds and Cancellations

Sender Refunds

Senders may request a refund under the following conditions:

• Before Redemption: Full refund if gift has not been accessed or redeemed by recipient (minus payment processing fees)
• After Partial Redemption: No refund for redeemed amounts; remaining balance may be refundable at our discretion
• After Full Redemption: No refunds

Refund requests must be submitted within 30 days of purchase through your account dashboard or by contacting support.

7. Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIFTWELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability to you for all claims shall not exceed the amount you paid to GiftWell in the twelve (12) months preceding the claim, or $100, whichever is greater.
